ISPFindr Terms of Service

These terms apply to the ISPFindr Android app and the ispfindr.com website, which are developed and published on Google Play by GenByte ("we", "us"). They explain what you can expect from us and what we expect from you.

Please read them carefully. By creating an account or using ISPFindr, you agree to these terms. If you don't agree, don't use ISPFindr. Our Privacy Policy explains how we handle your information, and isn't part of these terms.

About these terms

ISPFindr is a network diagnostics service. It lets you analyse your Wi-Fi and internet connection, run speed tests, find internet service providers near you, read and write reviews, and send reports to providers. Many of these features are free and some don't require an account.

If you're using ISPFindr on behalf of a business, such as a provider that manages a listing, you confirm that you're authorised to accept these terms for that business, and "you" includes that business.

Who can use ISPFindr

You must be at least 13 years old, or the minimum age required in your country to agree to these terms if that is higher. If you're under the age of majority where you live, you need permission from a parent or legal guardian to use ISPFindr.

You may not use ISPFindr if we have previously suspended your account for breaking these terms, or if applicable law prohibits you from using it.

Your account

  • Give accurate information when you create your account and keep it up to date.
  • Keep your sign-in details secure. You're responsible for what happens under your account, unless it's caused by our failure to protect it.
  • Use one personal account. Don't create accounts to inflate or damage a provider's rating, or to get around a suspension.
  • Tell us promptly at [email protected] if you think someone else has accessed your account.

You can stop using ISPFindr at any time, and you can delete your account in the app or on the web.

Using the diagnostic tools

ISPFindr includes tools that examine networks and connections, including Wi-Fi and Bluetooth scanning, local network device discovery, ping, traceroute, speed tests and a network traffic inspector that uses a local VPN on your device.

  • Use these tools only on your own device and on networks you own or have permission to test.
  • Don't use them to monitor other people, access networks or devices without authorisation, or collect other people's information.
  • Speed tests run on servers operated by ISPFindr. Don't use them for load testing, benchmarking at scale, or anything that could harm our servers or other users' tests.
  • Results are estimates. Signal readings, speeds and diagnoses depend on your device, network conditions and other factors outside our control.

Provider accounts

Internet service providers and upstream network operators can manage a listing on ISPFindr. If you register a provider account:

  • You must prove control of each network number (ASN) you add, using the one-time code we send to the contact registered for that network. Don't register a network you don't operate or aren't authorised to represent.
  • One account can manage one listing.
  • Keep listing information accurate and current, including packages, prices, coverage areas, phone numbers and payment details.
  • Use the reports you receive only to investigate and resolve the customer's problem, and handle the information in them in line with applicable data protection law. Don't use it for marketing, and don't retaliate against customers for reviews or reports.
  • You may reply to reviews and reports, but you may not pressure customers to change or remove them, or offer anything in exchange for positive reviews.

Reviews and reports that customers write about your network belong to those customers. They stay on ISPFindr if you remove your listing or delete your account.

We may remove or suspend a listing that is fraudulent, impersonates another operator, or repeatedly misstates prices or coverage.

Reviews, comments and reports

Rules for what you post

  • Write only about your own genuine experience with that provider.
  • Don't post fake, paid or incentivised reviews, or reviews about a competitor or your own business.
  • Don't post content that is abusive, threatening, hateful, sexually explicit, or that harasses anyone, including a provider's staff.
  • Don't post other people's personal information, or content you don't have the right to share.
  • Don't send reports you know are false.

Your content

You keep ownership of what you post. By posting it, you give GenByte a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and distribute that content, and to adapt its format, for the purpose of operating, promoting and improving ISPFindr. This licence ends when you delete the content or your account, except for copies that have already been shared with a provider through a report, or that we must keep for legal reasons.

Moderation

We don't review all content before it's posted, and we aren't responsible for what users post. We may remove content, or limit its visibility, if we reasonably believe it breaks these terms or the law, or could harm users, providers or ISPFindr. Where we remove your content, we'll tell you why when we're able to.

To report content you believe is unlawful or breaks these terms, use the report option in the app or email [email protected] with a link to the content and the reason.

Acceptable use

When using ISPFindr, don't:

  • Break the law or encourage others to do so.
  • Scrape, crawl or bulk download data from ISPFindr, except through search engine indexing of public pages, without our written permission.
  • Reverse engineer, decompile or modify the app, except where the law allows it.
  • Interfere with or disrupt ISPFindr, try to access it in ways we haven't provided, or probe, scan or test the vulnerability of our systems without permission.
  • Upload malware or anything designed to harm devices, networks or data.
  • Impersonate any person, provider or organisation, or misrepresent your connection to them.
  • Use ISPFindr to send spam or unsolicited commercial messages.

Provider and network information

Provider details such as packages, prices, coverage and contact information are supplied by providers. Network information such as ASNs, address ranges and operator names comes from public internet registries and other third-party sources. Ratings reflect the opinions of users.

We work to keep this information useful, but we don't guarantee that it's accurate, complete or current. Confirm details directly with a provider before you sign up for a service.

ISPFindr isn't an agent, reseller or partner of any provider, unless we say so explicitly. A connection request made through ISPFindr is only an introduction. Any contract, installation, billing or dispute is between you and the provider.

Our content and software

ISPFindr, including its software, design, logos and the content we create, is owned by GenByte or our licensors and protected by intellectual property laws. We give you a personal, worldwide, royalty-free, non-assignable and non-exclusive licence to use the ISPFindr app and website as permitted by these terms. You may not use our name or logos without our written permission.

Some parts of ISPFindr use third-party content, such as map imagery and open source software, which are subject to their own licences and attributions.

If you send us feedback or suggestions, we may use them without any obligation to you.

Changes to the service

We're constantly improving ISPFindr, so we may add or remove features, change how they work, or set limits on their use. The app may update automatically to fix errors or add improvements. If we make a significant change that negatively affects your use of ISPFindr, or stop offering it, we'll give you reasonable advance notice where possible, and a chance to delete your account.

Suspension and termination

We may suspend or terminate your access to ISPFindr, or remove content, if you materially or repeatedly break these terms, if we're required to by law, or if your conduct creates risk or legal exposure for users, providers or us. Where reasonable, we'll notify you first, explain why, and give you a chance to fix the problem.

Sections of these terms that by their nature should continue after termination, including those on your content licence, disclaimers, limitation of liability and disputes, will continue to apply.

Disclaimers

ISPFindr is provided "as is" and "as available". To the extent permitted by law, we don't make any warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. In particular, we don't promise that ISPFindr will be uninterrupted or error-free, that diagnostic results or provider information will be accurate, or that following any suggestion in the app will fix a connection problem.

Nothing in these terms limits rights you have as a consumer that can't be limited by contract under the law of the country where you live.

Limitation of liability

To the extent permitted by law:

  • We aren't liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or business opportunities, arising from your use of ISPFindr.
  • We aren't liable for the acts, services or content of providers, other users or third parties, including any agreement you make with a provider.
  • Our total liability for any claim arising from these terms or ISPFindr is limited to the greater of the amount you paid us to use ISPFindr in the 12 months before the claim, or USD 50.

These limits don't apply to liability for death or personal injury caused by negligence, fraud, or any other liability that can't be limited by law.

If you use ISPFindr on behalf of a business, that business agrees to indemnify GenByte against claims, losses and costs arising from its use of ISPFindr or its breach of these terms, to the extent permitted by law.

Governing law and disputes

If you have a problem with ISPFindr, please contact us first at [email protected] so we can try to resolve it informally.

These terms are governed by the laws of Bangladesh, where GenByte is based, without regard to its conflict of law rules. Disputes will be resolved in the courts of Dhaka, Bangladesh.

If you're a consumer living in another country, you also keep the protection of the mandatory laws of your country of residence, and you may bring a claim in the courts of that country where local law gives you that right.

General

  • Changes to these terms. We may update these terms to reflect changes to ISPFindr or the law. We'll show the effective date above, and give you advance notice of material changes, such as through the app. If you don't agree to the new terms, stop using ISPFindr and delete your account.
  • Entire agreement. These terms are the entire agreement between you and us about ISPFindr, and replace any earlier agreements on the same subject.
  • Severability. If any part of these terms can't be enforced, the rest remains in effect.
  • No waiver. If we don't act on a breach of these terms right away, we don't give up any rights we have.
  • Assignment. You may not transfer your rights under these terms without our consent. We may transfer ours to an affiliate or to a successor in a merger, acquisition or sale of assets.
  • App stores. If you downloaded the app from Google Play, Google's terms also apply to your use of Google Play, and Google isn't responsible for ISPFindr.
  • Language. If these terms are translated, the English version prevails where the law allows.
